Email: support@rogb.art

2. Scope and acceptance

These Terms apply to use of www.rogb.art and to orders placed through the Website.

By placing an order, you confirm that you are at least 18 years old, have legal capacity to contract, and accept these Terms.

3. Artworks and availability

Artworks are described and photographed as accurately as reasonably possible. Colours may vary between screens.

Unless stated otherwise, each original artwork is unique and subject to availability.

Adding an item to the cart does not reserve it.

4. Orders and contract

An order is an offer to purchase. A binding contract is formed only when payment is accepted and ROGB ART sends an order confirmation.

We may reject or cancel an order before dispatch for lack of availability, incorrect pricing, suspected fraud, delivery restrictions or another legitimate reason.

Any payment received for a cancelled order will be refunded.

5. Prices, taxes and payment

Prices are shown in euros. Applicable taxes and delivery charges are shown before payment.

Payment is processed securely through Stripe or another method displayed at checkout.

ROGB ART does not store complete card details.

6. Delivery

Delivery terms, estimated times, restrictions and charges are described in our Shipping & Payment Information.

Delivery dates are estimates unless expressly agreed otherwise.

7. Right of withdrawal and returns

Consumers purchasing at a distance normally have 14 days from the day after receiving the artwork to withdraw without giving a reason.

The customer must clearly notify ROGB ART within that period and return the artwork within 14 days after notification.

The customer bears the direct cost of return shipping, suitable packaging, insurance and tracking, unless the item is defective, damaged in transit or not as ordered.

Full details and the statutory exceptions, including clearly personalised or commissioned works, appear in our Returns & Refunds Policy.

8. Defective or damaged goods

Nothing in these Terms limits mandatory consumer rights.

If an artwork arrives damaged, defective or materially different from its description, contact support@rogb.art promptly with the order number, photographs of the item and packaging, and a description of the issue.

9. Intellectual property

Purchase of an artwork transfers ownership of the physical object only.

Copyright and all reproduction, distribution, adaptation and commercial image rights remain with the artist unless agreed in writing.

Website content and artwork images may not be reproduced or used commercially without prior written permission.

10. Liability

ROGB ART does not exclude liability that cannot lawfully be excluded.

Subject to mandatory law, we are not liable for indirect or unforeseeable loss, business loss, or delay caused by events beyond reasonable control.

11. Privacy

Personal data is handled according to our Privacy Notice and Cookie Policy.

12. Governing law and disputes

These Terms are governed by Portuguese law, without depriving consumers of mandatory protections applicable in their country of residence.

The parties should first try to resolve complaints by contacting support@rogb.art.

Consumers may also use an applicable Portuguese consumer dispute-resolution entity or the competent courts.

13. Changes and contact

The version published when an order is placed applies to that order.
